These Terms of Service (“Agreement”) are between the emotice.com website and mobile application (hereinafter “Platform” or “EMOTICE”) and the person using the Platform (“User” or “You”).

By using the Platform, you accept, declare, and agree that:

WARNING: Registration of persons under 16 years old is strictly prohibited. Legal responsibility for age declaration rests entirely with the User.

EMOTICE is an emotional intelligence and personal development platform that provides:

• Daily mood recording (emoji-based)
• Emotional pattern analysis
• Historical data and statistics

3.2. AI Companion (Optional Feature)

• Motivational conversations with GPT-4o-mini
• Personalized emotional support
• Pattern-based recommendations

CRITICAL: The AI companion is NOT a therapist, psychologist, or medical professional. It provides general wellness guidance only.

3.3. Data Insights

• Visual reports
• Trend analysis
• Export functionality

4. User Responsibilities

4.1. Account Security

• Keep your password secure
• Do not share your account
• Notify us immediately if your account is compromised

4.2. Accurate Information

• Provide truthful information
• Update your data when necessary
• Do not impersonate others

4.3. Appropriate Use

You agree NOT to:

• Use the Platform for illegal purposes
• Upload malware or harmful code
• Harass, threaten, or harm others
• Violate intellectual property rights
• Attempt to hack or disrupt the Platform

5. Subscription and Payment

• 3 AI messages per day
• 30-day history

5.2. Premium Tier ($9.99/month)

• Unlimited AI messages
• Advanced insights
• Data export
• Priority support

5.3. Payment Terms

• Payments processed via Stripe
• Automatic renewal unless canceled
• Refunds within 14 days of first payment only
• Prices subject to change with 30-day notice

6. Intellectual Property

6.1. EMOTICE Rights

All Platform content (design, code, text, logos, graphics) is owned by EMOTICE and protected by copyright.

6.2. Your Content

• You retain ownership of your mood data and notes
• You grant EMOTICE a license to store and process your data for service delivery
• We do NOT claim ownership of your personal data

7. Medical Disclaimer

EMOTICE IS NOT:

• A medical device
• A diagnostic tool
• A treatment for mental illness
• A replacement for professional therapy

EMOTICE IS:

• A wellness and self-awareness tool
• For informational purposes only
• Not FDA-approved

If you experience:

• Suicidal thoughts → Call 988 (USA) or 112 (Turkey)
• Severe depression or anxiety → Contact a mental health professional
• Medical emergency → Call emergency services immediately

8. Limitation of Liability

EMOTICE is NOT responsible for:

• Decisions made based on information obtained from the Platform
• Inaccuracy or incompleteness of AI responses
• Technical failures, data loss, or service interruptions
• Third-party attacks (hacking, DDoS, etc.)
• Misuse of shared information

The Platform is provided “AS IS.” No warranties are given. Use at your own risk.

9. Privacy and Data Protection

For detailed information about personal data processing, please read our Privacy Policy. You have rights under KVKK and GDPR.

10. Changes to Terms

EMOTICE reserves the right to change this Agreement without prior notice. Changes take effect immediately upon publication on the Platform.

Version number and date are indicated at the top of this page. Continued use of the Platform after changes constitutes acceptance of the new Terms.

11. Applicable Law and Jurisdiction

This Agreement is subject to the laws of the Republic of Turkey. Istanbul Courts and Enforcement Offices have jurisdiction over disputes arising from the Agreement.
